The Employee Retention Credit ("ERC") was first implemented to help employers retain employees during the 2020 COVID-19 pandemic. It was initially introduced under the CARES ACT as a fully refundable tax credit for the March 12, 2020 - January 1, 2021 time period. 

Since then, the ERC has been extended and expanded with the passing of the American Rescue Plan Act. If the Tax Relief for American Families and Workers Act is enacted, the ERC is expected to end prematurely on January 31, 2024.

Due to fraudulent activities from ERC mills and subsequent error-filled credit claims, the Internal Revenue Service has intensified audits and investigations. They are flagging erroneous claims and sending out audit letters.
